1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and AipanGirl ("we," "us," or "our"), concerning your access to and use of the aipangirl.com website. By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service.
2. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
Specific Note on Aipan Art: While Aipan is a traditional folk art form, the specific designs, adaptations, and digital representations created by our artisans and displayed on this platform are protected intellectual property. Unauthorized commercial reproduction is strictly prohibited.
3. User Representations
By using the Site, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete.
- You have the legal capacity and you agree to comply with these Terms of Service.
- You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Site.
- You will not use the Site for any illegal or unauthorized purpose.
4. Products and Purchases
Handcrafted Nature: You acknowledge that all products listed are handcrafted. Slight variations in color, texture, and finish are inherent to handmade products and are not considered defects. These variations make your piece unique.
Availability: All products are subject to availability. We reserve the right to discontinue any product at any time for any reason. Prices for all products are subject to change.
Orders: We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
5. Returns and Refunds
Please review our Return Policy posted on the Site prior to making any purchases. Generally, we accept returns for damaged or incorrect items reported within 48 hours of delivery. Due to the artisanal nature of our products, we typically do not accept returns for "change of mind" to protect our artisans' livelihoods, unless otherwise specified.
6. Governing Law
These Terms shall be governed by and defined following the laws of India. AipanGirl and yourself irrevocably consent that the courts of Uttarakhand, India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
